La natura delle cose
2022
The reference to the nature of things is still working today in legislation and jurisprudence. In this article the reasons for the persistence of this line of reasoning in law and in the legal science are examined. These reasons generally depend on the close connection between law and some fundamental social relations. But also the essential need to assure its effectiveness, without which law would be useless. In turn, the contemporary evolution of the legal culture requires a change in the way of understanding the nature of things. Nowadays, the nature of things distances itself from mere objectivism to get close to the deliberative character of the determination of the law
On "Coherence" and "Law": An Analysis of Different Models
2001
The aim of this paper is to compare different conceptions of the role of (normative) coherence in the legal field. More precisely, it aims to deepen Neil MacCormick's theory of legal reasoning, in which coherence is essentially considered an interpretative tool, and Ronald Dworkin's legal theory, in which coherence occupies a more crucial place. The main results of this paper can be summarized in two points. A) For Dworkin, coherence is not just an interpretative standard but constitutes the hard core of his theory of law. B) As a consequence of A, Dworkin's reflections on coherence (as an interpretative standard) cannot be separated from his theory of law grounded on the concept of integri…
Neil MacCormick's Second Thoughts on Legal Reasoning and Legal Theory. A Defence of the Original View
2011
This paper offers a diachronic reconstruction of MacCormick's theory of law and legal argumentation: In particular, two related points will be highlighted in which the difference between the perspective upheld in Legal Reasoning and Legal Theory and the later writings is particularly marked. The first point concerns MacCormick's gradual break with legal positivism, and more specifically the thesis that the implicit pretension to justice of law proves legal positivism false in all its different versions. The second point concerns MacCormick's acceptance of the one-right-answer thesis and the consequent thinning of the differences between MacCormick's theory of legal reasoning and that of Ron…

Ragionamento giuridico. Particolarismo. In difesa di un approccio psicologistico
2017
Legal Reasoning, Particularism: In Defense of a Psychologistic Approach. In this paper I recommend a close examination of the reasons favouring a deep and potentially far reaching reorientation of legal theory, and of the theory of norms and norm-based reasoning and decision-making generally, namely, the adoption of a psychologistic approach (“psychodeontics”). I argue in favour of psychologism - not in the anstract, but - with reference to rwo particular topics: legal reasoning (specifically, the justification of judicial decisions) and the project of a of two-tier (principles v. rules) theory of law, informed by a particularistic conception of practical reasoning. I show that there are as…

The first point concerns MacCormick’s gradual break with legal positivism, and more specifically the thesis that the implicit pretension to justice of law proves legal positivism false in all its different versions. In brief, MacCormick uses the argument of the implicit pretension to justice of law against the thesis of the separability between law and morality and, accordingly, against legal posit…
